Supreme Court resumed hearing of the petitions against some provisions of the 18th amendment on Thursday.
A 17-member bench, headed by Chief Justice Iftikhar Muhammad Chuadhry, is hearing the cases against some clauses of the 18th amendment.
During the hearing, Justice Javed Iqbal said that judiciary’s freedom is not a crystal doll that could be cracked. Advocate Akram Chaudhry of Rawalpindi Bar has completed his arguments before the court while counsel of Ijazul Haq, Ghufarul Haq has initiated his arguments. Justice Javed Iqbal remarked that as per the basic laws no state could legislate against the basic rights of the citizens, and added that the judges are exempted of the employment tenure and prosecution.
Justice Saqib Nisar observed that the approval of the name of the judge to-be-appointed by the parliamentary committee would equate to the public confidence on judiciary. Justice Saqib again asked that the attorney general used to give proposals in the old appointing system too, then how his inclusion in the new judicial commission is termed as against judiciary’s freedom. Akram Chaudhry argued that the inclusion of law minister and attorney general would hinder the court proceedings
